The CUSTOMER’s sole and exclusive remedy in the event of CADLINK’s failure to fulfill any of the obligations under this Agreement is the right to terminate the Agreement.

In no event shall CADlink be liable for any damages resulting directly or indirectly from the use of the Licensed Software provided. This warranty gives you specific legal rights, and you may also have other rights that vary from region to region. Some regions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Neither CADlink or anyone else who has been involved in the creation, production, or delivery of this product shall be liable for any direct, indirect, consequential or incidental damage (including damage for loss of business profits, business interruption and loss of business information). You assume the entire risk of using the Licensed Software.
You are advised to test the Licensed Software thoroughly before relying on it. Because of the diversity of conditions and hardware under which the Licensed Software may be used, no warranty of merchantability or fitness for a particular purpose is given. Other than the above limited warranty, CADlink makes no other warranties whatsoever, whether legal or conventional, express or implied, with respect to the Licensed Software. If failure of the medium has resulted from accident, abuse or misapplication, CADlink shall have no responsibility to replace the medium or refund the purchase price.

You agree upon such termination to destroy the Software together with all copies in any form.ĬADlink warrants that the DVD medium upon which the Software is recorded shall be free from defects in materials and workmanship under normal use and service for a period of ninety (90) days from the date of delivery to you, as evidenced by a copy of your receipt. If you transfer the Software, then you must at the same time either transfer all copies (whether in printed or machine-readable form) to the same party, or destroy any copies not transferred. Transfer the Software and license to another party, provided that the party agrees to accept the terms and conditions of this agreement. Use the Software only on a single computer.Ĭopy the Software into any machine-readable or printed form for backup purposes in support of your use of the Software on the single computer.
